By accessing or using any services provided by Bid Mailers LLC (“Bid Mailers,” “we,” “us,” or “our”), including our website, mobile application, and direct mail marketing platform (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.
If you create a Bid Mailers account, your purchase and use of the platform services are governed by the Bid Mailers Service Agreement you accept in the mobile app. These Terms govern use of our public website and apply to account holders only to the extent they do not conflict with the Service Agreement. If these Terms conflict with the Service Agreement with respect to your account or the platform services, the Service Agreement controls.
Bid Mailers is a direct mail marketing platform for residential home services contractors. Our Services include remote property measurement, custom estimate design, printing, and USPS mailing of branded estimate packets to homeowner addresses selected by our customers, across the service verticals available in the app.
To use certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts that violate these Terms.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
Mailers are billed at the current per-mailer rate (currently $3.50 per mailer, all-inclusive), plus applicable taxes where we are required to collect them. Your payment method on file is charged before each week's batch is produced, and batches typically ship by the end of that week. If you do not have any pending addresses in a given week, nothing ships and nothing is charged. Undeliverable addresses are removed before printing and are not charged. Payments are non-refundable once production of a batch has begun. Full billing terms, including the first-order minimum and credits, are in the Service Agreement.
The Services, including all content, features, and functionality, are owned by Bid Mailers and are protected by copyright, trademark, and other intellectual property laws. Your custom branding and content remain yours. By uploading content to the Services, you grant us a limited license to use it solely for the purpose of providing the Services to you.
The Services and this website are provided “as is” and “as available.” Bid Mailers disclaims all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and uninterrupted availability. Property measurements are estimates derived from remote imagery, and we do not guarantee marketing results, response rates, or postal delivery timing.
To the fullest extent permitted by law, neither party shall be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Services, including lost profits or lost revenue. Except for a party's indemnification obligations, fraud, gross negligence, or willful misconduct, or your payment obligations, each party's total liability for any claim arising from these Terms or the Services shall not exceed the greater of the amount you paid to us in the three (3) months preceding the event giving rise to the claim and $1,000.
These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law provisions. Before filing any claim, you agree to contact us at admin@bidmailers.com and attempt in good faith to resolve the dispute informally for sixty (60) days. Except for claims that qualify for small claims court, any dispute arising under these Terms shall be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Commercial Arbitration Rules, and neither party may participate in a class, collective, or representative action. You may opt out of arbitration by emailing admin@bidmailers.com with the subject line “Arbitration Opt-Out” within thirty (30) days of first accepting these Terms. Any dispute not subject to arbitration shall be resolved in the state or federal courts located in Washington County, Oregon. For account holders, the Dispute Resolution section of the Service Agreement governs platform disputes.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page, and material changes will apply prospectively only, after we post the updated Terms (and, for account holders, after the notice required by the Service Agreement). Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
